  1. Scope

1.1 These General Terms and Conditions (GTC) of DiaCore-Management GmbH (hereinafter referred to as "Seller") apply to all orders for goods placed by consumers or entrepreneurs (hereinafter referred to as "Customer") via our online shop. The customer's conditions do not apply unless we have agreed otherwise.


1.2 A consumer is a natural person who concludes a transaction for private purposes that are not predominantly related to his or her commercial or independent professional activity.


1.3 An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity.


  1. Conclusion of the contract

2.1 The product descriptions in our online shop do not constitute a binding offer, but enable you to make a binding offer.


2.2 To make an offer, place the desired products in the shopping cart and complete the order process by clicking on the corresponding button. This sends a legally binding offer for the goods in your shopping cart.


2.3 The seller has five days to accept your offer. Acceptance can take place in various ways:

- By written confirmation (e.g. by email or fax).

- By delivering the goods.

- By requesting payment after your order.


If one of the options mentioned comes first, the contract is concluded. The period for acceptance begins on the day after you submit your offer and ends on the fifth day after that. If the seller does not accept your offer within this period, it is considered rejected.


2.4 If you choose a payment method offered by PayPal, payment will be processed in accordance with the applicable PayPal terms of use. If you do not have a PayPal account, the terms for payments without a PayPal account apply. By choosing a PayPal payment method, you declare your consent and your offer will be accepted as soon as you complete the order process.


2.5 After you have submitted your offer, we will save the contract text and send you a copy in text form. The contract text will not be made available to you in any additional form.


2.6 Before submitting your binding order, you can identify and correct any input errors. To do so, use the magnification function of your browser to better read the information on the screen.


2.8 The language selection is made in the online shop. Communication is usually via email. Please check the accuracy of your specified email address to ensure that you receive all emails sent by us.


  1. Right of withdrawal

3.1 Consumers generally have a right of withdrawal.


3.2 Detailed information on your right of withdrawal can be found in our cancellation policy.


3.3 The right of withdrawal does not apply to consumers whose residence and delivery address are outside the European Union.


  1. Prices and payment terms

4.1 Unless otherwise stated, prices are total prices including statutory VAT. Any additional delivery and shipping costs are listed in the product description.


4.2 For deliveries outside the European Union, additional costs may arise that are not borne by the seller. These include, for example, transfer fees or customs duties.


4.3 The available payment options are displayed in the online shop.


4.4 If advance payment has been agreed, payment is due immediately after conclusion of the contract, unless another due date has been agreed.


4.5 Payment with “SOFORT”: The payment is processed via SOFORT GmbH. You need an online banking account that is activated for this payment.


4.6 Payment by credit card via Stripe: If you select this payment method, the invoice amount is due immediately. Stripe reserves the right to carry out a credit check.


  1. Delivery and shipping conditions

5.1 If shipping is offered, delivery will be made to the address you provide. If you pay via PayPal, the address stored there applies.


5.2 If delivery fails for reasons for which you are responsible, you must bear the resulting costs. This does not apply to return costs within the scope of your right of withdrawal.


5.3 For entrepreneurs, the risk of accidental loss or deterioration of the goods passes to the buyer as soon as the seller hands over the goods. For consumers, the seller bears the risk until the goods are handed over.


5.4 Right of withdrawal in case of unavailability: The seller can withdraw from the contract if the self-delivery does not take place properly. The seller will do everything possible to procure the goods.


5.5 Self-collection: Unfortunately, self-collection is not possible for logistical reasons.


  1. Retention of title

The seller reserves ownership of the delivered goods until the purchase price has been paid in full.


  1. Liability for defects (warranty)

Unless otherwise agreed, the statutory provisions on liability for defects apply.


7.1 Entrepreneurs: The seller has the choice of the type of subsequent performance. The limitation period for claims for defects is one year from delivery.


7.2 Exceptions: The limitations of liability do not apply to claims for damages, fraudulently concealed defects and to goods that were used for a building.


7.3 Recourse claims: The statutory limitation periods for recourse claims remain unaffected.


7.4 Obligations of merchants: Merchants must inspect the goods upon receipt and report any defects immediately.


7.5 Notes for consumers: Please report any obvious transport damage immediately to the deliverer and inform us.


  1. Redemption of promotional vouchers

8.1 Promotional vouchers can only be redeemed in the online shop and within the specified period of validity.


8.2 Some products may be excluded from the voucher promotion.


8.3 Promotional vouchers must be redeemed before completing the order process.


8.4 Multiple promotional vouchers can be redeemed in one order.


8.5 The value of the goods must be at least equal to the amount of the promotional voucher.


8.6 If the value of the promotional voucher is insufficient, the difference can be paid using other payment methods.


8.7 The balance of a promotional voucher will not be paid out in cash.


8.8 If goods paid for with promotional vouchers are returned, the voucher will not be refunded.


8.9 Promotional vouchers are not transferable.


  1. Applicable Law

9.1 All legal relationships between the parties shall be governed by German law, unless mandatory protective rights of the consumer’s country of residence are affected.


9.2 This choice of law does not apply to consumers outside the European Union.


  1. Jurisdiction

For merchants, legal entities under public law or special funds under public law, the place of business of the seller is the exclusive place of jurisdiction.


  1. Alternative Dispute Resolution

11.1 The EU Commission offers a platform for online dispute resolution: [ODR platform](https://ec.europa.eu/consumers/odr).


11.2 The Seller does not participate in dispute resolution proceedings before a consumer arbitration board.
